Agreement
By using Overrated / Underrated, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the app. If you are under the age of legal majority where you live, a parent or guardian should review these terms with you.
Using the app
We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for lawful, noncommercial entertainment, subject to these terms and the applicable app store rules.
You may not copy, sell, rent, distribute, reverse engineer, interfere with, or misuse the app or service except where applicable law expressly permits it.
Player conduct
Overrated / Underrated is a social game. You are responsible for the display name, custom topic, and other content you submit and for how you interact with other players. Do not:
- submit unlawful, threatening, harassing, hateful, sexually exploitative, or privacy-invasive content;
- impersonate another person or misrepresent your affiliation;
- attempt to disrupt rooms, bypass safeguards, automate abuse, or access another player’s device or data; or
- use the app in a way that violates another person’s rights or applicable law.
We may limit or block access, remove content, or suspend service when reasonably necessary to protect players, enforce these terms, or comply with law.
Rooms, topics, and availability
Rooms are temporary and are not designed as permanent storage. Do not rely on the app to preserve room history, votes, custom topics, or results. You grant us the limited permission needed to process content you submit for operating the room and service.
We may add, change, or remove features, topic packs, or content, and we may suspend the service for maintenance, security, or other operational reasons. We do not guarantee that every room or feature will be continuously available.
Optional purchases
If paid topic packs are offered, purchases are processed by the app store shown at checkout. Prices, taxes, billing, cancellations, and refunds are governed by that store’s terms. Except where law or store policy requires otherwise, digital purchases are final after delivery.
A purchased pack may require the same store account and an internet connection to restore. We may change how content is presented or organized, but we will not intentionally remove access to a valid entitlement without a legitimate legal, security, store-policy, or technical reason.
Disclaimers and liability
To the fullest extent permitted by law, the app and service are provided “as is” and “as available,” without warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, or non-infringement. Player-submitted content and opinions belong to the players who provide them; we do not endorse them.
To the fullest extent permitted by law, Overrated / Underrated will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from use of the app. Nothing in these terms excludes rights or liability that cannot legally be excluded.
Illinois law
These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except where the law where you live requires otherwise. Any dispute that is not required to be handled elsewhere by law will be brought in a state or federal court with jurisdiction in Illinois.
Changes and severability
We may update these terms as the app changes. The revised version will be posted here with a new effective date. If any provision is found unenforceable, the remaining provisions will continue to apply. Our failure to enforce a provision is not a waiver.
